The Cowichan Valley Regional District has won one of their two cases before the B.C. Supreme Court.
The B.C. Supreme Court has ruled that using the contaminated soil dump site at 640 Stebbings Road as a landfill is prohibited against the Cowichan Valley Regional District zoning bylaw.
The Cowichan Valley Regional District sought an order that prohibits South Island Resource Management from operating its contaminated soil and storage facility on Stebbings Road.
CVRD legal counsel presented arguments and evidence to support their position that Cobble Hill Holdings’ dumping of contaminated soil is not a permitted use under the zoning for the property.
The ruling comes as people around the globe celebrate World Water Day.
